Terms of Service

These Terms govern your use of footnotes, its beta website at footnotes.rest, and related beta services operated by Doppler HQ, Inc. ("Doppler", "we", "us"). By using Footnotes, you agree to these Terms and our Privacy Policy.

Beta notice. Footnotes is experimental software. Features, storage formats, availability, and supported platforms can change, and the service may contain defects. Keep separate copies of anything you cannot afford to lose.

1. The service

Footnotes is an offline-first notebook for writing and deliberately capturing photographs, voices, ambient sound, location, and ordinary moments. It may also offer beta signup, analytics, and optional enrichment features. The current app does not provide a Footnotes cloud account or hosted notebook sync.

2. Eligibility

You must be at least 13 to use Footnotes. If you have not reached the age at which you can agree to these Terms where you live, a parent or legal guardian must agree for you. You may not use Footnotes where doing so would violate applicable law.

3. Your content

You retain ownership of the notes, photographs, recordings, transcripts, and other material you create. You grant Doppler a limited, non-exclusive licence to host, copy, transmit, and process material only as needed to provide a feature you choose, such as beta support or optional hosted enrichment. This licence ends when the relevant material is deleted from our systems, subject to legal obligations and reasonable backup cycles.

4. Capturing other people

You are responsible for what you capture and where you capture it. Laws about recording conversations, photographing people, location, confidentiality, and intellectual property vary. Obtain any consent or permission required before recording, photographing, uploading, or sharing material involving someone else. Do not use Footnotes to secretly record people where doing so is unlawful or would violate a reasonable expectation of privacy.

5. Device permissions and enrichment

Camera, microphone, speech-recognition, photo-library, and foreground location features depend on permissions you control through your device. Optional enrichment can transmit a completed note and its associated media to the endpoint configured for that build. Review the Privacy Policy before using those features.

6. Acceptable use

You agree not to use Footnotes to break the law, infringe another person's rights, distribute malware, probe or disrupt our systems, bypass security controls, or upload material you have no right to process. You may not resell or exploit the beta service except with our written permission.

7. Availability, backups, and data loss

Footnotes is provided as a beta and may change or stop without notice. On-device storage can be lost through device failure, app removal, operating-system behavior, or software defects. You are responsible for maintaining another copy of important material. We do not promise that capture, transcription, enrichment, recovery, or playback will always succeed.

8. Third-party services

Footnotes relies on platform and infrastructure providers, including Apple or Google services, Amplitude, website hosting, and any enrichment endpoint you use. Their own terms and privacy policies may apply. We are not responsible for third-party services outside our control.

9. Ending use

You may stop using Footnotes at any time and delete the app or individual notes. You may ask us to delete beta signup or other information held by Doppler by emailing hi@doppler.life. We may suspend access to hosted beta features if needed to protect users or systems, comply with law, or address a breach of these Terms.

10. Disclaimers

To the fullest extent permitted by law, Footnotes is provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, accuracy, or data preservation. Transcriptions and automated observations may be incomplete or wrong.

11. Limitation of liability

To the fullest extent permitted by law, Doppler and its affiliates will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for lost data, profits, revenue, or opportunities, arising from Footnotes. Nothing in these Terms limits liability that applicable law does not allow us to limit.

12. Changes to Footnotes or these Terms

We may change Footnotes and these Terms as the beta develops. We will update the date above and provide additional notice where appropriate. If you do not agree to an update, stop using the service.

13. Governing law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law rules. Disputes are subject to the non-exclusive jurisdiction of state and federal courts in King County, Washington. Mandatory consumer rights where you live remain unaffected.
